A EUROPEAN CALL FOR REGULARISATION AND DIGNITY

We, civic actors from across Europe and Members of the European Parliament are calling on the Belgian government to meet their commitments stated this summer to the negotiators of the Union des Sans-Papiers pour la Régularisation (USPR). 

In July 2021, the State Secretary for Migration stated that the hunger strikers’ applications would be considered admissible and fully reviewed and that proof of prior employment, including undeclared work, would be considered positively. This ended a 56 day-long hunger strike and built hope among those asking their fundamental rights to be respected.

4 months later strikers started to get negative answers with government compromises not respected. People whose applications have been refused, have also been given an obligation to leave the territory, and are at greater risk of detention and deportation. Police harassment has increased on the strikers, especially on spokespersons, who are regularly stopped, their identities checked and picked up by the police and then released.

The case of undocumented people in Belgium is not an exception; the lives of undocumented people in many situations across Europe are at stake. Migrants in Calais are also currently undertaking hunger strikes. All around Europe, migrants are victims of systematic violations of fundamental rights and blackmail strategies between countries, as in the EU-Belarus border. Further to this, the coming Pact on Asylum and Migration will exacerbate the challenges and worsen the situation of undocumented migrants across Europe. 

Everyone should have access to basic rights and dignity, irrespective of their migration status.

It is urgent to support undocumented people and to uphold their rights. And it is even more urgent in light of the COVID-19 pandemic. 

In light of all this:

• We call on the Belgian government to, firstly, go back to their promises before the strikers and evaluate their demands based on clear criteria. Secondly, to put forward a concrete and durable policy on regularisation.
• We call on the European Institutions to enforce the Conventions Member States are signatories of, notably the European Convention of Human Rights.

UN APPEL EUROPÉEN EN FAVEUR DE LA RÉGULARISATION ET DE LA DIGNITÉ

 

Nous, acteurs civiques de toute l’Europe et membres du Parlement européen, demandons au gouvernement belge de respecter les engagements pris cet été envers les négociateurs de l’Union des Sans-Papiers pour la Régularisation (USPR). 

 

En juillet 2021, le Secrétaire d’Etat à la migration a déclaré que les demandes des grévistes de la faim seraient considérées comme recevables et entièrement examinées et que les preuves d’emplois antérieurs, y compris le travail non déclaré, seraient considérées positivement. Cette déclaration a mis fin à une grève de la faim de 56 jours et a redonné espoir à celles et ceux qui demandaient le respect de leurs droits fondamentaux.

 

Quatre mois plus tard, les grévistes ont commencé à recevoir des réponses négatives, les compromis du gouvernement n’étant pas respectés. Les personnes dont la demande a été refusée ont également reçu l’obligation de quitter le territoire, et risquent ainsi d’être détenues et expulsées. Le harcèlement policier s’est accru sur les grévistes, en particulier sur les porte-parole, qui sont régulièrement arrêtés, contrôlés et pour certains embarqués par la police, puis relâchés.

 

Le cas des sans-papiers en Belgique n’est pas une exception ; la vie des sans-papiers est en jeu dans de nombreuses situations à travers l’Europe. Des migrants à Calais entreprennent également des grèves de la faim. Partout en Europe, les migrants sont victimes de violations systématiques des droits fondamentaux et de stratégies de chantage entre pays, comme à la frontière entre l’UE et la Biélorussie. De plus, le prochain Pacte sur l’Asile et la Migration va exacerber les défis et aggraver la situation des sans-papiers à travers l’Europe. 

 

Toute personne devrait avoir accès aux droits fondamentaux et à la dignité, quel que soit son statut migratoire.

 

Il est urgent de soutenir les personnes sans-papiers et de faire respecter leurs droits. Et c’est encore plus urgent à la lumière de la pandémie de COVID-19. 

 

Dans ce contexte

• Nous demandons au gouvernement belge, premièrement, de revenir sur ses promesses devant les grévistes et d’évaluer leurs demandes sur base de critères clairs. Deuxièmement, de mettre en avant une politique concrète et durable de régularisation.

 

• Nous demandons aux institutions européennes de faire respecter les conventions dont les Etats membres sont signataires, notamment la Convention européenne des droits de l’Homme.
